About the Complete Seating Network
Each of the restaurants, wineries, resorts or other hospitality operations that use the Complete Seating service have adopted Complete Seating’s proprietary Electronic Reservation System (“the Complete Seating System”) to replace their traditional pen-and-paper reservation books. These businesses may be owned in part or in whole by groups that include multiple businesses and other affiliated businesses (hereinafter referred to as “hospitality group”).
The hospitality group's websites interact with the Complete Seating Systems to find available tables, to secure, change or cancel online reservations, communicate via email, SMS/text messaging, phone, and to confirm that reservations were honored.
An online reservation may also be made through a hospitality operation’s website or via a Complete Seating affiliate’s web link. Similarly, your personal information, including but not limited to name, telephone number, email and contact preference, is passed through from these sites onto the Complete Seating System.
This document describes how Complete Seating System user information is collected, stored, used and shared with hospitality operations via their Complete Seating System.
You will be asked to provide a name and either a telephone number or email address in order to complete the reservation. Complete Seating will use your telephone number or email address to send automated service messages pertaining to your reservation based on your registered preference.
The hospitality operation and their ownership have the right to use your personal information as they see fit.
Complete Seating will use this email address for no other purpose unless you have consented to receive marketing communications from Complete Seating.
Complete Seating users may have certain information (such as VIP status) shared throughout the Complete Seating network of hospitality groups. Hospitality groups cannot access the information or visit histories of Complete Seating users other than guest's histories in their specific hospitality group.
Users outside of the United States should understand that all information shared during the registration and reservation processes is sent to and stored on secure servers that are located in the United States. The United States has data protection laws that may not be consistent with those of other countries. If Complete Seating transfers your information outside of your host country, Complete Seating will take steps to ensure that your privacy rights continue to be protected.
What information is accessible to hospitality operations:
When you make a reservation using the hospitality operation’s website with Complete Seating’s widgets, your personal information is provided to that hospitality group. You also have the option of providing special preferences or comments regarding your reservation, which Complete Seating will pass on to that hospitality group.
Complete Seating will only share the information specified above with the hospitality group at which you have made reservations using the hospitality operation’s website or telephone numbers. hospitality groups cannot use their Complete Seating System to access information pertaining to guests or visit histories from other hospitality groups, with the exception that hospitality operations under the same partial or whole ownership may elect to share guest information between properties.
Email, SMS/text messages and phone calls from Complete Seating:
Complete Seating sends automated service messages pertaining to upcoming or recent reservations, such as confirmations, reminders, and/or invitations to provide guest feedback. You cannot unsubscribe from any service messages.
Email, SMS and phone calls from hospitality operations:
You may also consent to receive marketing communications from the hospitality operation at which you've made a reservation. Complete Seating plays no role in the content, frequency, timing or un-subscription process of any hospitality operation's marketing communications. If you would like to unsubscribe from a hospitality operation's marketing communications, please contact the appropriate hospitality operation directly.
Complete Seating hospitality operation websites can provide helpful information based on where you are. If you tell us or the hospitality group where you are (i.e., by allowing your mobile device to send us your location), we may use that information to provide you with location-based information. If you want to deactivate this feature, you can disable location services on your mobile device, please contact your carrier for more information.
You can choose to access certain third party social media web sites and services through the hospitality operation websites. When you do so, you are sharing information with those sites, and the information you share will be governed by their privacy policies. You can modify your privacy settings with those third parties directly. Complete Seating does not control the privacy policies of such third parties and assumes no responsibility or liability for the actions of such third parties.
Purposes of use of your personal information:
Complete Seating may use your personal information for the following purposes:
- to secure your reservation at the Complete Seating hospitality operation you've selected, by providing your name, personal contact telephone number and email to that hospitality operation,
- to provide services which guests are entitled to under applicable terms and conditions,
- to produce aggregate statistical data for the improvement of services offered by the Complete Seating network and affiliated hospitality group websites,
- to provide hospitality groups with information about your usage of their facilities to improve the management of those affiliated businesses,
- for any other purposes related to those above.
Cookies, web beacons and logging:
Web pages may contain electronic images (called a "single-pixel GIF" or "web beacon") that are used to count users who have visited that page, or to access certain cookies.
How Complete Seating uses your personal information:
Complete Seating will never sell, rent, loan or otherwise distribute any of your personal information to any third party without your prior expressed written consent, although Complete Seating will pass all information on to hospitality operations at which you make reservations as described above.
Complete Seating does use aggregate data (based partly on IP addresses of website visitors) collected through hospitality group websites to analyze website usability, system performance and usage trends. While this data, in its aggregate form only, may be shared with third parties with whom Complete Seating works to analyze it, the data will only be shared under the strictest terms of confidentiality and will never contain any personally identifiable information pertaining to any user of the Complete Seating Websites.
The information collected through the hospitality group’s websites can be collected by those hospitality groups and used as they see fit in both actual and aggregated forms.
Specifically, through an association with a company named Google, Inc. ("Google"), Complete Seating may use website code and the Google Analytics auditing software to track page views and entry and exit points to and from Complete Seating hospitality operation websites. Google may place and analyze the cookies on your internet browser to help determine the effectiveness of Complete Seating hospitality operation advertising and marketing campaigns as well as the hospitality group’s advertising marketing campaigns. Again, the data collected will only be used in an aggregate form and will not contain any personally identifiable information, and only Complete Seating, Complete Seating hospitality groups and Google will have access to this aggregate data.
How hospitality operations may use your personal information:
Hospitality operations and hospitality groups in the Complete Seating network primarily use guest information provided through their own websites to secure the desired reservations. Additionally, as noted above, the hospitality operation may use the guest’s email address and telephone number to send marketing materials.
Complete Seating hospitality groups want to provide you with the best possible service so that you will visit them again. One way hospitality groups can distinguish themselves is by recognizing returning guests and recalling their special preferences. For this reason, a hospitality group may use its Complete Seating System to take note of your special requests, allergies, special occasions or other pertinent information that will help the hospitality group serve you better during your next visit. If a hospitality group chooses to note your preferences, that information may be typed into its Complete Seating System manually just as a hospitality group might write a note on an index card. This data belongs to the hospitality group, since it is a product of that hospitality group's relationship with you. Complete Seating does not access or use this information, and it is not shared with any other Complete Seating hospitality group or third party, other than, perhaps, a hospitality operation under the same ownership. Complete Seating does create back-up copies of all information stored on the Complete Seating System for that hospitality operation, to assist in the restoration process in the event of data loss.
The hospitality groups within Complete Seating’s network are separate businesses from Complete Seating. While Complete Seating encourages them to comply with data protection requirements, Complete Seating will not be responsible if these hospitality groups fail to comply with respect to your information. Any complaints or inquiries regarding use of your information by an Complete Seating hospitality group, or marketing communications from an Complete Seating hospitality group, should be addressed directly to the hospitality group in question.
Disclosure, correction, suspension of use of personal information:
If you wish to have Complete Seating disclose to you the personal information held by Complete Seating and the means through which Complete Seating obtained such information, or if you desire the information's correction, suspension of use, or to be informed of the purpose of use by Complete Seating, please contact Complete Seating. (Contact information is provided in the "Contacting Complete Seating" section below.) Upon receiving the request, Complete Seating shall meet such request pursuant to the provisions of each applicable privacy regulation after it confirms that such request has been made by you personally.
Contacting Complete Seating:
1. WHAT WE DO
Complete Seating provides the Services to GUEST for the purpose of assisting GUEST in securing reservations at participating third party hospitality operations (each operation that is part of a “Hospitality Group”). In response to a GUEST’s online request, the Complete Seating Service determines if a Hospitality Group can accept the reservation. The availability of reservations is determined at the time of GUEST’s query. Once a reservation is made by GUEST, Complete Seating will provide confirmation of the reservation to GUEST by email, SMS/text or phone call depending on the requested method. By using the Services, GUEST agrees to receive reservation confirmations by email after booking a reservation through the Hospitality Group’s Site.
2. NO SHOW POLICY
Complete Seating is committed to providing superior quality services to its GUESTS and Hospitality Groups. To assist us in maintaining a consistently high level of service with the participating Hospitality Groups and patrons, GUESTS are asked to cancel any reservations that they will be unable to honor at least 30 minutes in advance on the day of the reservation. You may cancel your reservation online or call the hospitality operation directly. In the case of larger party reservations, where the hospitality operation has requested a credit card, you may be required to cancel your reservation in accordance with that hospitality operation's individual cancellation policy, which will always be shared with the GUEST at the time the reservation is made.
If you are unable to keep your reservation and you fail to cancel, Complete Seating will send you an email letting you know that our records indicate that you were a no-show. By using the Services, GUEST agrees to receive no-show confirmations by email after a Hospitality Group and/or the Complete Seating Service reports your reservation was not honored, whether or not that was in fact the case. Your Complete Seating guest profile may be terminated or blocked if you no-show for four reservations within the same twelve-month period. GUEST agrees that all final no-show determination will be made by Complete Seating and Hospitality Groups in its sole discretion.
4. USAGE GUIDELINES
The Services are being offered to GUEST for GUEST’s personal use. GUEST agrees to use the Services only to book reservations at participating Hospitality Operations and Hospitality Groups and then honor those reservations by arriving at the Hospitality Operations(s) on time and ordering and paying for a meal. GUEST further agrees not to book more than one (1) reservation for GUEST’s personal use during any one meal time (e.g., lunch, dinner, etc.). GUEST may be able to book multiple reservations through Complete Seating’s Administrative Assistant and/or Concierge programs. Resale or attempted resale of reservations is prohibited, and is grounds for, among other things, cancellation. Complete Seating expressly reserves all its rights and remedies under applicable state and federal law.
Any and all other uses which are unlawful or in violation of this Agreement's terms and conditions are prohibited. Complete Seating reserves the right, in its sole discretion, to refuse service, terminate accounts, remove or edit content, or cancel reservations.

6. INTELLECTUAL PROPERTY AND GRANT OF RIGHTS TO USER
The materials and services provided for and depicted on the Complete Seating Service or Hospitality Group’s website are protected by copyright, trademark, patent and other intellectual property laws. All text, graphics, video, data or other content on the Complete Seating Service ("Complete Seating Content") is provided to GUEST by Complete Seating for the sole purpose of using the Services. GUEST shall not copy, display, modify, create derivative works of, publish, or sell the Complete Seating Content or any information, software, or services provided by Complete Seating hereunder. The Complete Seating Content may be modified from time to time by Complete Seating in its sole discretion. Except as expressly set forth herein, no license is granted to USER for any other purpose, and any other use of the Services or the Complete Seating Content by GUEST shall constitute a material breach of this Agreement. Nothing in this Agreement shall affect any rights of Complete Seating or its licensors in the Services or Complete Seating Content, and any associated patents, trademarks, copyrights, mask work rights, trade secrets or other intellectual property rights. No license, right or interest in any trademarks of Complete Seating or any third party is granted under this Agreement. Nothing in this Agreement shall affect any rights of Complete Seating or its licensors in the Services or Complete Seating Content, and any associated patents, trademarks, copyrights, mask work rights, trade secrets or other intellectual property rights. No license, right or interest in any trademarks of Complete Seating or any third party is granted under this Agreement.
7. COMMUNICATIONS, AND OTHER CONTENT
GUEST may submit requests, send e-mails, SMS/text and other communications; and submit suggestions, ideas, comments, questions, or other information for publication and distribution to hospitality operations and other third parties, so long as the content is not illegal, threatening, obscene, racist, defamatory, libelous, pornographic, infringing of intellectual property rights, promoting of illegal activity or harm to groups and/or individuals, invasive of privacy, purposely false or otherwise injurious to third parties or objectionable and does not consist of or contain software, computer viruses, commercial solicitation, political campaigning, chain letters, mass mailings, any form of "spam" or references to illegal activity, malpractice, purposeful overcharging, false advertising or health code violations (e.g., foreign objects in food, food poisoning, etc.). You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of content. Complete Seating reserves the right (but not the obligation) to remove or edit such content, but may not regularly review submitted content.
If you do submit material, and unless we indicate otherwise, you grant Complete Seating a nonexclusive, perpetual, royalty-free, irrevocable, and fully sublicensable right to use, modify, reproduce, adapt, translate, publish, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you submit; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Complete Seating for all claims resulting from content you supply. Complete Seating has the right but not the obligation to monitor and edit or remove any activity or content, including but not limited to content that violates the standards of this website, as determined by Complete Seating in its sole discretion. Complete Seating takes no responsibility and assumes no liability for any content submitted by you or any third party.
8. ACCESS AND INTERFERENCE
Much of the information on the Complete Seating Service is updated on a real time basis and is proprietary or licensed to Complete Seating by its Hospitality Operations, Hospitality Groups or third parties. By using the Complete Seating Service, you agree not to:
- Use any robot, spider, scraper or other automatic device, process or means to access the Complete Seating Service for any purpose without Complete Seating’s express written permission.
- Take any action that imposes or may impose (in Complete Seating’s sole discretion) an unreasonable or disproportionately large load on our infrastructure.
- Implement any manual processes to monitor or copy Complete Seating Content from the Complete Seating Service without express written permission.
- Utilize any device, software or routine that will interfere or attempt to interfere with the functionality of the Complete Seating Site.
9. LIABILITY LIMITATIONS
IN NO EVENT SHALL COMPLETE SEATING BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISES OUT OF OR IS ANY WAY CONNECTED WITH (I) ANY USE OF THE SERVICES, THE COMPLETE SEATING SERVICE OR THE COMPLETE SEATING CONTENT, (II) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO, THE USE OR INABILITY TO USE ANY COMPONENT OF THE SERVICES OR THE COMPLETE SEATING SITE FOR RESERVATIONS), OR (III) THE PERFORMANCE OR NON-PERFORMANCE OF ANY HOSPITALITY OPERATION IN CONNECTION WITH THE SERVICES. IN ADDITION, ALL USERS SPECIFICALLY UNDERSTAND AND AGREE THAT ANY THIRD PARTY DIRECTING USERS TO THE COMPLETE SEATING SITE BY REFERRAL, LINK OR ANY OTHER MEANS IS NOT LIABLE TO USER FOR ANY REASON WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSS ASSOCIATED WITH THE USE OF THE SERVICES, THE COMPLETE SEATING SERVICE OR THE COMPLETE SEATING CONTENT. COMPLETE SEATING IS NEITHER AN AGENT OF NOR IS CONNECTED WITH ANY AFFILIATED HOSPITALITY OPERATION OR HOSPITALITY GROUP IN WHICH A USER HAS MADE A RESERVATION. ASIDE FROM THE SERVICES PROVIDED ON THE COMPLETE SEATING SERVICE. COMPLETE SEATING IS NOT LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH A USER’S VISIT TO AN AFFILIATED HOSPITALITY OPERATION.
10. DISCLAIMER OF WARRANTY
THE INFORMATION, PROGRAMS, PRODUCTS, AND MATERIALS CONTAINED IN OR ACCESSED ON THE COMPLETE SEATING SERVICE, INCLUDING, WITHOUT LIMITATION, THE SERVICES AND THE COMPLETE SEATING CONTENT, ARE PROVIDED TO USER ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. COMPLETE SEATING DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, WITH RESPECT TO THE SERVICES, THE COMPLETE SEATING SERVICE, THE COMPLETE SEATING CONTENT AND RELATED MATERIALS PROVIDED HEREUNDER INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING.
11. LINKS TO THIRD PARTY SITES
The Complete Seating Service may contain hypertext links to Web sites operated by parties other than Complete Seating. Such hypertext links are provided for GUEST’S reference only and Complete Seating does not control such Web sites and is not responsible for their content. Complete Seating’s inclusion of any hypertext links to such Web sites does not imply any endorsement of the material on such Web sites or any association with their operators.
If any of the provisions, or portions thereof, of this Agreement are found to be invalid under any applicable statute or rule of law, then, that provision notwithstanding, this Agreement shall remain in full force and effect and such provision or portion thereof shall be deemed omitted.
13. NO ASSIGNMENT
This Agreement and the rights granted and obligations undertaken hereunder may not be transferred, assigned or delegated in any manner by GUEST, but may be so transferred, assigned or delegated by Complete Seating.
14. NO WAIVER
Any waiver of any provision of this Agreement, or a delay by any party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor create an expectation of non-enforcement of that or any other provision or right.
15. GOVERNING LAW
This Agreement shall be governed and construed in accordance with the laws of the State of California. Any disputes arising out of this Agreement shall be resolved by binding arbitration through the American Arbitration Association in San Francisco, California, and under its then existing rules governing arbitration of commercial disputes. Any award made by an arbitrator shall be binding upon the parties and may be entered into judgment in a court of competent jurisdiction. The prevailing party in any arbitration shall be entitled to reimbursement of all costs associated with the arbitration from the losing party, including reasonable attorneys’ fees and expenses.
